Introduction of Mediation Software

BMK develops and commercializes the software package Wallie for the automation of brokerage firms, brokers and law firms and legal services that practice mediation, coaching practices and therapist practices.

To make our cooperation run as smoothly as possible, we repeat you like our starting points, as they were discussed during our product demonstration. After all, the successful use of your software depends on numerous factors, which we wish to emphasize from the outset.

Why choose Wallie?
Wallie is a standard software package, which is developed on the basis of the most common wishes and automation requirements of a standard user, be it a mediation practice, a lawyer-mediator or an individual mediator. Wallie is standard software, which was developed based on the specific wishes of the mediator. However, the package is still under development, in which the suggestions of our users are certainly taken into account and our package is further developed on a daily basis, which only benefits the user through our upgrades. It is a software package that is constantly evolving.

A good Wallie user considers our software to be the backbone of his office or service. Paper files are becoming superfluous. It is the intention that Wallie automates the file and customer file, calendar, invoicing, models, appointments, .... A thorough knowledge of the package ensures proper operation. If you are unable to continue for a while, further support is possible.

1. Scope and contact information

These Terms of Use apply to your use of Wallie www.bemiddelingsoftware.be and bms.bemiddelingsoftware.be and www.wallie.software, as well as the Wallie product. Further referred to as Wallie.

Before using Wallie in any way, you are kindly requested to read these Terms of Use, the Privacy Policy and the Cookie Statement carefully.

By visiting Wallie, or by any use thereof, you expressly agree to the Terms of Use, the Privacy Statement and the Cookie Statement. If you do not agree with their content when reading the Terms of Use, the Privacy Statement and/or the Cookie Statement, you are requested not to use Wallie any further.

Wallie is operated by BMK Solutions BVBA, a company incorporated under Belgian law, with registered office at 3530 Houthalen-Helchteren, Hortelstraat 37, and registered under company number BE 0678 407 310.

2. Purpose and content of Best Mediation Software

Wallie provides information about the services offered by BMK Solutions and allows interaction with BMK Solutions for, for example, arranging a meeting, asking for additional information, registering for an event, responding to a blog article, etc.

The information provided on Wallie is of a general nature and the user cannot derive any rights from this information. Unless stated otherwise, the information provided on Wallie does not in any way constitute an offer of services and/or products.

BMK Solutions makes great efforts to ensure that the information made available is complete, correct, accurate and up-to-date. Despite these efforts, inaccuracies may occur in the information provided.

You agree to use Wallie only in a manner that is in accordance with applicable law or with the legal or other rules specifically applicable to you. In addition, you agree not to use on Wallie any "deep links", "robots" or any other technology by which Wallie or its content may be used for any purpose other than as specified in these Terms of Use. You may not access content on Wallie that is not intended for you, for example by "hacking", "password mining", or by any other technique. You further agree not to test or test Wallie's vulnerability, if any.

3. Liability

BMK Solutions cannot be held liable in any way or under any circumstances, in a direct or indirect, general or special manner, for direct or indirect damage attributable to the use of Wallie, in particular as a result of links or hyperlinks, including, without limitation, of providing false information, all losses, work interruptions, damage to programs or other data on the user's computer system, hardware, software or otherwise.

Despite all efforts, Internet services can never be completely free of possible security risks. Therefore, BMK Solutions is not responsible for violations of the confidentiality of user data, for example when Wallie or the servers of BMK Solutions are attacked by third parties.

The content of Wallie can be modified, changed or supplemented at any time without notice or notification. BMK Solutions does not guarantee the proper functioning of the Website and cannot be held liable in any way for malfunctioning or temporary (un)availability or for any form of damage, direct or indirect, that would result from access to or using Wallie.

Wallie may contain hyperlinks to websites or pages of third parties or partners, or refer to them indirectly. Placing links to these websites or pages in no way implies an implicit approval of their content. BMK Solutions expressly declares that it has no control over the content or other features of these websites and can under no circumstances be held liable for the content or features thereof or for any other form of damage resulting from its use. BMK Solutions also refers to its own terms of use.

4. Accounts

Accounts other than registered for BMK Solutions' customers and accounts created in an automated manner are not allowed.

BMK Solutions cannot be held liable for the consequences of the unlawful and unauthorized use of Wallie through the use of your username and password. The user is responsible for any use of the username and password. You undertake not to pass on your username and password to any third party. If you nevertheless wish to give others access to Wallie from www.wallie.software, you can contact kevin@bmksolutions.be. The access to and use of Wallie by the users you have requested falls entirely outside the responsibility of BMK Solutions.

You may not use Wallie for any illegal or unauthorized purpose. You are responsible for all actions that occur through your account.

BMK Solutions will be entitled to terminate your account without warning in the event of non-compliance with these terms of use, in the event of written or verbal inappropriate or threatening behavior towards BMK Solutions employees or in the event of any misuse of Wallie, including misuse for advertising purposes.

5. Termination and Suspension

The licensee may terminate the agreement at any time after the end of the Initial Subscription Period. Cancellation is done by using the cancellation function in the Wallie application. The agreement ends at the end of the current Period at the time of termination.

If a payment owed by licensee to Wallie is not made on time, licensee will receive a request to pay immediately. If payment is then not made for 14 days, the licensee will receive a repeated payment request accompanied by the warning that, if payment is not made for another 14 days, the agreement will be terminated by Wallie with due observance of a notice period of one month.

If full payment is still not forthcoming, Wallie is entitled to terminate the agreement accordingly. This cancellation is done by means of a cancellation email. In the cancellation email, Wallie informs the licensee that (i) he still has one month to retrieve all data from the Wallie application and associated portals and (ii) that all data will be permanently removed at the time of termination of the agreement, unless the licensee still pays all amounts due in the meantime. If not all amounts already due are paid after one month, the agreement will end and all data in the Wallie application and associated portals of the licensee will be permanently deleted.

6. Intellectual Property

Any reproduction, public communication or re-use of Wallie or any part thereof, i.e. including - but not limited to - the text, images, codes, interface elements, information, images, video files and sound files contained therein, in any way whatsoever, is prohibited except with the express, written and prior consent of BMK Solutions.

7. Modifications

BMK Solutions always reserves the right to change these Terms of Use. It is your responsibility to regularly review the applicable Terms of Use and to observe the latest version thereof.

These Terms of Use were last revised on 15/11/2022.

8. Applicable Law

This Agreement and your relationship with Wallie shall be governed exclusively by, and will be enforced, construed, and interpreted exclusively in accordance with, the laws applicable in Belgium, court of Hasselt and shall be considered to have been made and accepted in Belgium, without regard to its conflict of law provisions. All disputes under this Agreement will be resolved by the courts of Belgium in Hasselt, and Subscribers consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. In any action or proceeding to enforce rights under this Agreement, the prevailing party shall be entitled to recover costs and legal fees.

In the event of a dispute, only the courts of the district of Hasselt are competent.
